Re: AGENCY INFORMATION COLLECTION ACTIVITIES: REVISION OF THE EMPLOYER INFORMATION REPORT (EEO-1) (EEOC-2016-0002-0001)

On behalf of Business Roundtable, an association of chief executive officers of leading U.S. companies, I am writing to express my concern with the Equal Employment Opportunity Commission (EEOC) proposal to require employers to expand the reporting of employee data to the federal government. If this rule i adopted, it will impose a high cost and burden on the part of employers, far in excess of government estimates, while providing limited utility, as detailed in the attached document.

The EEOC indicates that its proposal is to determine whether employees have a pay differential based on certain protected criteria, such as gender or race. We do not believe that the additional information the EEOC is seeking will provide accurate reporting on potential pay differentials. Our CEOs are leaders in successful diversity and inclusion strategies and have a recognized business imperative to attract, retain and develop the very best talent for our businesses. That means recognizing and rewarding talent based upon job responsibilities, education, productivity, merit, tenure and many other factors, which are not considered in the EEOC’s proposal.

The proposal should be withdrawn by the EEOC. Instead, the Administration should reach out to CEOs and work collaboratively on ways to encourage job growth based on training and education, promote efforts to support the recruitment and retention of employees, and eliminate unnecessary federal regulations so that U.S. companies can grow and help all employees prosper.
